CLE: The New Lawyer: How Settlement Strategies Have Affected the Responsibilities of Litigation Counsel

This program will focus on how settlement strategies and alternative dispute resolution programs, which are now part of our courts’ case management system, have affected our responsibilities to our clients. What ethical obligations does this impose on us as lawyers for clients in the litigation process? How does it impact our strategy and litigation management plan? Do we appear weak if we urge the parties to negotiate or mediate early on? How do we get all counsel to cooperate in an initial discovery plan that is based on a willingness to explore settlement once these initial stages of discovery are completed?
