New Zealand: Waikato Law Review Article on Therapeutic Jurisprudence
"Will Therapeutic Jurisprudence Provide a Path Forward for Maori?
by Toki, Valmaine
Abstract: The author examines the reasons for high rates of Maori offending and suggests a viable model to address and reduce Maori offending. He believes therapeutic jurisprudence can address the problem of disproportionate representation of Maori in the negative criminal justice statistics. Such therapeutic jurisprudence would necessitate the formation of a specialized court, adopting Maori customs, ethics and values. The system would address the underlying reasons for Maori offending using a Maori approach to achieve positive therapeutic outcomes."
